1. Acceptance of These Terms

These Terms of Service govern your use of the website operated by KSC Aviation Services LLC and the ramp services we provide from our office at 3363 Quincy Ave, Ogden - 84403-1133, United States (US). By visiting the site, sending a request or booking a turn, you agree to these terms. If you do not agree, please do not use the site or the desk.

These terms form a binding agreement between you and the company. Please read them together with our Privacy Policy, which explains how we handle personal information. If there is a conflict between these terms and a signed service agreement, the signed agreement controls for the services it covers.

We keep these terms available on the site so that you can review them at any time. Your continued use of the site after a change takes effect means that you accept the updated terms.

2. Definitions

In these terms, the company means KSC Aviation Services LLC. The desk means the ramp service team and the contact channels described on the site. The site means the pages published under the company web address.

A turn means the sequence of ground services we perform for an aircraft between its arrival and its departure. A customer means a person or organization that books or receives a service from the company. An aircraft owner means the registered owner or the operator who holds the aircraft for the flight in question.

Services means the ground handling and support work described on the site, including handling, fueling, tie-down, deicing, cleaning and equipment support. Content means the text, images and other material published on the site.

3. Eligibility and Authority

You may use the site and the desk only if you can form a binding contract and if you are at least the age of majority in your jurisdiction. If you act for a company, an operator or an owner, you confirm that you have the authority to bind that party to these terms.

If you book a service for an aircraft that you do not own or operate, you confirm that you have permission from the owner or operator to arrange that service. We may ask for evidence of that permission before we begin work.

We may decline a request, or stop a service, if we cannot confirm that the person making the request has the authority to do so, or if the request would put people, property or the ramp at risk.

4. Our Services

We provide line services to aircraft at Ogden, Utah and the surrounding area. Our services include aircraft ramp handling and marshalling, fueling coordination and quality checks, tie-down and hangar staging, deicing and cold-weather servicing, cabin and exterior cleaning turns, and ground equipment upkeep and scheduling.

We describe these services on the site so that you know what to expect, but a description is not a guarantee of a particular result. The service we actually provide is set out in the confirmation we send for your turn and in any signed service agreement.

We may add, change or remove a service at any time. If a change affects a turn you have already booked, we will tell you and offer an alternative where one is available.

5. Booking and Scheduling

You may request a service through the contact form, by email or by phone. A request is not a booking until we confirm it. We aim to confirm promptly, and we will tell you if a slot is not available or if we need more information.

Please give us accurate details, including the tail number, the expected arrival time, the requested services and any special need. If your arrival time changes, tell us as soon as you can so that we can adjust the schedule and hold the crew you need.

We schedule work in good faith, but a slot can shift because of weather, traffic, a mechanical issue or a priority request from an operator. We will keep you informed and we will do our best to serve you at the earliest safe moment.

6. Customer Duties

You agree to give us accurate and complete information for every turn. You agree to make the aircraft available at the confirmed time and to remove any item that could interfere with safe servicing. You agree to tell us about any known hazard, restriction or special procedure that applies to the aircraft.

You agree to keep the contact details in your request current, so that we can reach you about a change. You agree to pay the fees that apply to the services we provide, as set out in the confirmation or a signed agreement.

You agree not to use the site or the desk for an unlawful purpose, and not to attempt to interfere with the site or with the safety of the ramp. If you breach these duties, we may suspend your service.

7. Fees and Payment

Fees for our services are set out in the confirmation we send or in a signed agreement. We may quote a rate for a service and add a charge for a special request, an after-hours call or a supply that we must purchase for your turn.

Unless we agree otherwise in writing, invoices are due on the terms stated on the invoice. We may require a deposit, a purchase order or a credit arrangement before we begin a service. Late amounts may carry a reasonable interest charge where the law allows.

All amounts are stated in United States dollars unless we agree otherwise. You are responsible for any tax that applies to a service, except for a tax on our own income. If you dispute an invoice, please contact the desk promptly so that we can review it with you.

8. Safety and Ramp Rules

The apron is a controlled and hazardous area. Our team follows the safety rules of the airfield, the operator and the applicable authority. A person who enters the ramp must obey those rules, wear the required protective equipment and follow the direction of our lead.

We may stop a service, park an aircraft in a safe position or refuse a request when a condition is unsafe, such as severe weather, a fuel spill, a damaged surface or a hazard near the aircraft. Safety decisions made by our lead are final on the pavement.

You agree to make sure that people you send to the ramp follow the same rules. If a person you send acts unsafely, we may remove that person from the ramp and, if needed, end the service.

9. Aircraft Condition and Access

We service the aircraft in the condition in which it is presented to us. You confirm that the aircraft is airworthy for the ground activity requested and that all access points we need are available and undamaged when we begin.

If we discover a condition that prevents safe or complete service, such as a locked panel, a missing cap or a fluid leak, we will tell you and, where reasonable, note it on the ticket. We are not responsible for a delay that results from a condition we did not create.

We take care with every aircraft we touch, but minor marks can occur in ground handling. You agree to inspect the aircraft and tell us about a concern promptly, so that we can review it while the details are fresh.

10. Fuel and Deicing Services

Fuel and deicing are provided according to the grade, the volume and the fluid we confirm for your turn. You are responsible for telling us the correct grade and any restriction that applies to the aircraft, the tanks or the surfaces.

Fuel quantity is measured at the time of delivery, and the reading on our record is the quantity we served. Deicing is performed with the fluid and the method we agree for the conditions, and holdover time is a guide that can change with the weather.

If a fuel or deicing supplier is a third party, the terms of that supplier may also apply to the service. We will tell you when a third party supplier is involved and we will pass on the terms we know of.

11. Use of This Website

The site is provided for information and for making a service request. You may use the site for a lawful purpose and in a way that does not harm the site, the company or another user.

You agree not to copy the site in bulk, not to scrape it by automated means, not to attempt to gain access to a restricted area, and not to introduce code that could damage or disrupt the site. You agree not to misrepresent your identity or your authority when you use the site.

We may change, suspend or withdraw any part of the site at any time. We do not promise that the site will always be available, and we may take it down for maintenance without notice.

12. Intellectual Property

The site and its content, including text, design, graphics and the way they are arranged, are owned by the company or used with permission. These terms do not give you any ownership of that content.

You may view the site and print a copy of a page for your own use. You may not republish, sell, license or distribute the content in a way that competes with us or that misrepresents the company, unless we agree in writing.

The company name and any logo we use are our marks. You may refer to the company by name in an accurate and fair way, but you may not use a mark in a way that suggests a partnership or an endorsement that does not exist.

13. Third Party Materials

The site may refer to a third party, such as an airport authority, a supplier or a weather service. A reference is provided for convenience and does not mean that we endorse the third party or its products.

A third party site has its own terms and its own privacy notice. We do not control those sites and we are not responsible for their content or their practices. If you deal with a third party, the terms of that party apply to your dealings with it.

14. Disclaimer of Warranties

The site is provided on an as available basis. To the fullest extent the law allows, we disclaim all warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose and non infringement.

We do not promise that the site will be free of error, that it will be secure, or that the information on it is complete and current at every moment. A description of a service on the site is general, and the service we provide is set out in the confirmation for your turn.

Nothing in these terms removes a warranty or a right that the law does not allow us to remove. If a warranty cannot be disclaimed in your jurisdiction, the limits in these terms apply only as far as the law permits.

15. Limitation of Liability

To the fullest extent the law allows, the company is not liable for an indirect, incidental, special, consequential or punitive loss, or for a loss of profit, revenue, data or goodwill, that arises from your use of the site or a service.

Where liability cannot be excluded, our total liability for a claim is limited to the amount you paid us for the service that gave rise to the claim. This limit applies to all claims taken together, whether they are based in contract, in tort or on another ground.

These limits do not apply to fraud, to wilful misconduct or to a liability that the law does not allow us to limit. If a limit is found to be unenforceable, the remaining limits continue to apply.

16. Indemnity

You agree to indemnify and hold the company, its team and its suppliers harmless from a claim, a loss or an expense that arises from your breach of these terms, your misuse of the site or a service, or your failure to give us accurate information about an aircraft.

This duty covers reasonable legal costs and the cost of defending a claim. We will tell you promptly about a claim that falls under this section, and we will work with you on the defence where it is reasonable to do so.

The duty does not apply to a claim that arises from our own negligence or from a breach of these terms by the company. Each party is responsible for its own share of a loss.

17. Force Majeure

We are not liable for a delay or a failure to perform that is caused by an event beyond our reasonable control. Such an event can include severe weather, a natural disaster, a fire, a flood, a labour dispute, a fuel shortage, a cyber incident, a government action, a runway closure or a public health emergency.

When such an event occurs, we will tell you as soon as we can and we will take reasonable steps to reduce the effect. If the event continues for a long period, either party may end the affected service without further liability.

18. Suspension and Termination

We may suspend or end your access to the site or your service at the desk if you breach these terms, if you use the site or the desk in a harmful way, or if we must do so to protect safety, property or the law.

You may stop using the site at any time. If you have a signed agreement, the termination terms in that agreement apply to the services it covers, and any amount owed for work already performed remains payable.

The sections of these terms that are meant to survive termination, such as intellectual property, disclaimer, liability, indemnity and governing law, continue to apply after the relationship ends.

19. Governing Law and Disputes

These terms are governed by the laws of the State of Utah, without regard to a conflict of law rule that would point to another jurisdiction. The courts located in Utah have jurisdiction over a dispute that arises from these terms or from a service, unless the law requires another forum.

Before we take a dispute to a court, we ask that you contact the desk so that we can try to resolve the matter directly and in good faith. Many issues can be settled with a short conversation and a review of the service record.

If a provision of these terms is found to be invalid, the rest of the terms remain in effect. Our failure to enforce a provision is not a waiver of that provision.

20. Changes to These Terms

We may update these terms from time to time to reflect a change in our services, our practices or the law. When we make a material change, we will post the new version on this page and update the effective date at the top.

We encourage you to review these terms when you use the site. If a change is significant, we will take reasonable steps to bring it to your attention. Your continued use of the site or the desk after a change takes effect means that you accept the updated terms.
